The development proposal was for up to 150 homes on the edge of Swanland.

Following the Council’s refusal of the scheme, we secured permission on appeal.

Following this, our planning permission was legally challenged by the Council (alongside another permission which we secured on appeal; a scheme of 380 homes in Pocklington).

The Councils legal challenge focused around the appropriate approach to calculating five year land supply in circumstances where assessments were updated during the course of the appeal and the Council’s requirement was due to change in a few weeks’ time.

Gladman successfully defended the claim. The Judgment upheld the Inspector’s finding that the five-year housing land supply should be based upon the local plan housing requirement for the full five-year period, even when it was clear the requirement would then fall.
